Halle Berry And Ex Reach Agreement In Court

HOLLYWOOD HILLS—Actress Halle Berry and her ex-boyfriend, Gabriel Aubry, have come to an agreement in family court over custody of their four-year-old daughter.
Attorneys for Berry and Aubry were in court on Thursday, November 29 in Los Angeles and it was announced that the two sides decided on an agreeable custody settlement after a closed door meeting. However, the terms of the deal were not released. Aubry, a Calvin Klein model, was present in court, but Berry was not.
The former couple have a four-year-old daughter, Nahla, together and have been involved in a custody battle for months. On Thanksgiving morning, Aubry was dropping off Nahla at Berry's Hollywood Hills home when a fist fight ensued between Aubrey and Berry's fiance, Olivier Martinez. Both men were taken to Cedars-Sinai Medical Center, but only Aubrey was arrested and taken into custody on suspicion of misdemeanor battery.

Berry responded by issuing an emergency restraining order that required Aubry stay 100 yards away from Berry, Nahla and Martinez. Aubry claimed Martinez threatened to kill him during the fight and took out a restraining order himself against Martinez.
Aubry stated in court documents that he was about to get back in his car when Martinez told him they needed to talk. "All of a sudden, Mr. Martinez jumped on me on the side of my body, and punched me such that he had taken me down to the ground," Aubry said.
"He continued to punch me at least two or three times, kicked me in the ribs with his knee or foot, and took my head in his hands and slammed it to the concrete driveway." Aubry claimed he was unable to defend himself and took photos of his unmarked hands as evidence.
He also stated that Martinez was threatening him during the attack and yelled out, "You cost us $3 million dollars. When you see the judge, you're going to tell him you're going to Paris or I'm going to kill you." The remarks are reported to refer to Berry's failed attempt to move Nahla to Marinez's native France.
Martinez claims it was Aubry who instigated the fight by shoving him and throwing a punch at his face which missed and hit his shoulder. Police reports refer to Aubry as the instigator of the physical altercation. Aubry is scheduled to appear in court for the Thanksgiving incident on December 13.
