Lindsay Lohan Agrees To Rehab In Plea Bargain
Posted by Ivetta Babadjanian on Mar 18, 2013 - 11:11:06 AM

SANTA MONICA—Actress Lindsay Lohan had trouble arriving on time for her court date on Monday, March 18 regarding a hearing that decided whether she would face jail time or avert a trial on charges stating she lied to police.

Lohan's hearing was scheduled for 8:30 a.m. but she did not arrive to the Los Angeles court house until 9:20 a.m. Upon her way inside the courtroom, an unidentified person threw glitter at Lohan. The proceedings did not start until 10:25 a.m. as the judge spoke with her attorney, Mark Jay Heller, and prosecutors behind close doors.

The actress allegedly missed her original flight on Sunday night from New York to Los Angeles. Instead, she traveled on a private plane that was provided by a Los Angeles based energy drink company for which she has made various promotional appearances.

"Thanks Mr. Pink for the private jet see you all in a few hours in LA," Lohan tweeted early Monday morning.

Lohan faced charges of lying to a police officer about her June car crash in Santa Monica as well as reckless driving and violating her probation for a shoplifting conviction.

Santa Monica prosecutors allege that Lohan lied when she told officers she was not driving a Porsche on June 18 when it rear-ended a truck as she was going to the set of "Liz & Dick." The actress has continued to be under some form of probation since she was arrested twice in 2007 for driving under the influence.

During a court hearing on March 1, Los Angeles Superior Court Judge James Dabney told Heller, Lohan's recently acquired attorney, that he needs to fully understand California criminal law for the case as he is licensed in New York.

"Somebody needs to come in to assist you who has some experience in California law for procedure, or Miss Lohan is going to have to come in here and waive her right to have attorneys who are competent in California law and procedure to go forward," said Dabney.

Lohan did not have to attend her trial as her charges are misdemeanors, but Dabney stated that Lohan would have to make an appearance on Monday if Heller did not have an experienced California criminal lawyer with him.

Lohan's previous California lawyer, Shawn Holley, left the case this year after keeping Lohan out of jail for probation violations and allegations in 2011 that she stole a $2,500 necklace.

The 26-year-old's father, Michael Lohan, reached out in order to allegedly help his daughter despite their public feud. He hired Orange County criminal lawyer David Wohl hoping that his daughter would let him defend her. Wohl attempted to persuade Lohan via Twitter on Friday, March 15. "@lindsaylohan My law firm was hired by your Dad. He wants nothing but the best for you. We will be there Monday to help, if we're allowed."

After a two-hour meeting in Dabney's chambers, Lohan pleaded no contest to misdemeanor reckless driving and providing false information to police.
A charge of willfully resisting, obstructing or delaying an officer was dismissed. She has agreed to serve 90 days in a locked rehab facility, perform 30 days of community service in addition to undergoing 18 months of psychotherapy sessions.

She must also pay an undisclosed fine in order to pay restitution to the truck driver she hit and complete a two-year probation. Dabney also sentenced her to 180 days in jail but if Lohan complies with the terms of her deal, then she won't be facing jail time. Proof of Lohan's enrollment in a residential treatment facility must be presented to the judge by May 2.

Lohan was booked by Santa Monica police on Tuesday, March 19 as a formality and was released immediately after taking her sixth mug shot.

Lohan's return to acting was debuted on Lifetime's "Liz & Dick" which received mixed reviews from critics and viewers. Her current film alongside porn star James Deen by Bret Easton Ellis, "The Canyons," is yet to be released. She will also reportedly make a guest appearance on Charlie Sheen's "Anger Management" and appear in the parody "Scary Movie 5" hitting theaters in April.
