MALIBU—On August 24, a man pleaded not guilty to allegedly strangling a pelican to death, according to the Los Angeles District Attorney's Office.

The accused man, 30-year-old Sergio Alvarez, allegedly strangled the animala California Brown Pelicanon August 22 in the Malibu pier area.

Witnesses indicate that the suspect allegedly choked the pelican, causing the bird to struggle violently until it went limp and died.

A deputy from the Malibu/Lost Hills Sheriff's Station was flagged down by a witness about the alleged incident near the Malibu Pier at about 5:50 p.m.

Witnesses directed the deputy to Alvarez, who reportedly made comments about the pelican, leading the deputy to suspect that Alvarez killed the animal.

Alvarez, believed to be a transient who frequents the Malibu Pier area, was arrested for felony animal cruelty and booked at the Malibu/Lost Hills Station of the Los Angeles County Sheriff's Department. He was initially held on $20,000, but prosecutors requested that the amount be raised to $30,000, according to the Los Angeles District Attorney's Office.

"He [Alvarez] pleaded not guilty to one count of felony animal cruelty," Jane Robison, of the L.A.D.A., told Canyon News. "His preliminary hearing is set for September 5 at Van Nuys Superior Court in Department 122."

L.A.D.A. indicates that Alvarez allegedly intended to eat the pelican, as he had been unable to catch any fish.

The L.A.C.S.D. states that California Brown Pelicans are no longer listed as endangered but are still a fully protected species in California.   For additional information, visit
