SANTA MONICA — The family of a man killed last year in a traffic collision has filed a lawsuit against the city of Santa Monica as of November 1.

Donald and Martha O’Dell, parents of Patrick O’Dell, are suing the city ofSanta Monica for negligence that lead to the wrongful death of their son.

Patrick O’Dell was riding his motorcycle on November 20, 2012 when he collided with a Big Blue Bus on Sunset Boulevard. He was 25 years-old. The bus driver, Timothy Datryn Thrash, is also named as a defendant.

According to the suit, O’Dell was driving his motorcycle around 10:30 a.m. in a “lawful and reasonable manner” as he traveled southbound on Sunset Boulevard. The bus was turning left onto Sunset from the area of Marquez Place and Marquez Avenue around the same time. It is alleged that Thrash “negligently drove” the bus in such a manner that led to the death of O’Dell.

The suit also states that the “dangerous and defective condition of public property” led to the tragedy, specifically including factors like the signage and markings of the road of that area that created a dangerous circumstance for any motorist. The suit does not indicate a specific amount that the family is seeking.

Chief Deputy City Attorney Jeanette Schachtner responded to a request from Canyon News for a comment on the suit saying, “The accident is very sad, but neither the city of Santa Monica nor its bus driver is responsible for what happened.”
