HOLLYWOOD—Actress Kelly Rutherford, 46, has been granted temporary sole legal and physical custody of her two children: son Hermes, 8, and daughter Helena, almost 6.

On May 22 a California judge declared that her children be brought back home to the United States. They have been living in France and Monaco with their father Daniel Giersch, Rutherford’s ex-husband, since 2012.

It’s still unclear whether Monaco courts will honor the California ruling.

In 2012, Giersch’s United States visa was revoked so a California judge ruled that the two children had to live with him in Europe and Rutherford would have to visit although they shared joint custody.

A hearing at a Los Angeles Superior Court is set to take place on June 15 with Rutherford, Hermes, Helena and Giersch or his representative in attendance.

Rutherford played Lily van der Woodsen in The CW hit series “Gossip Girl.”
