EAST HOLLYWOOD—Rosario Maximilia Valdezinda, 39, entered a no contest plea on Monday, January 13 for fatally striking a pedestrian while texting and driving in 2019, the Los Angeles County District Attorney’s Office announced. Valfezinda pleaded to one felony count of vehicular manslaughter with gross negligence.

Prosecutors on the case stated that the defendant was texting while driving on West Sixth Street in Los Angeles the night of January 23, 2019. Yong Do Kim, 65, was fatally struck by with Valfezinda’s SUV, as he was crossing the roadway at South Grand View Street.

Sentencing is scheduled to take place on February 19, 2020 at Department 123 of the Foltz Criminal Justice Center in Los Angeles. The California Department of Corrections will determine if Valdezinda will face probation or up to two years in state prison.

The case was investigated by the Central Traffic Division of the Los Angeles Police Department.
