SAN FRANCISCO—San Francisco 49ers star Bruce Miller was arrested for suspicion of assault on Monday, September 5. The 29-year-old tight end was arrested in San Francisco, by authorities after getting into a scuffle with two hotel guests at the Marriott Hotel.

According to the Washington Post, Miller uploaded a photo to Instagram showing him and two other people sitting at the bar at the Palm House restaurant in San Francisco. KTVU spoke to an unidentified employee of the restaurant who told them that Miller visited the bar three different times and was drunk.

According to police, at 2:40 a.m. an intoxicated Miller tried to check into the Fisherman’s Wharf Marriott Hotel, but it was full. He tried to enter a room that was occupied by an elderly couple. The couple’s 29-year-old son confronted Miller and told him he was in the wrong room and the football player attacked him. The 70-year-old father came to assist his son, but was punched in the face by Miller. Both men were taken to the hospital to be treated for their injuries.

NBC Bay Area spoke with Dinesh Shreshta, the front desk manager at Travelodge, who indicated that Miller was sitting on a flight of stairs in the hotel, vomiting intermittently and bleeding from a wound on his forehead. Miller was booked into the San Francisco County Jail and arrested on four felony courts, two which are criminal threats, one of assault with a deadly weapon (not a firearm), one of elder abuse and a misdemeanor battery charge. His bail was set at $178,000.

The 49ers announced on Twitter Monday that Miller had been released from the team.

“The San Francisco 49ers organization is aware of the media report regarding Bruce Miller,” the organization said in a statement. “We are gathering the relevant facts of this matter and will continue to monitor the situation.” He joined the team back in 2011 as a fullback. He was later moved to the position of tight end courtesy of new coach Chip Kelly.

According to the Associated Press, Miller’s agent and lawyer Jack Reale told them that he was still gathering information regarding the incident. Miller was arrested back in 2015 and pleaded no contest to a misdemeanor charge of disturbing the peace in connection with a March incident involving his ex-fiancé. Miller allegedly threw the woman’s cellphone and smashed it during an argument at a Santa Clara hotel. He had to attend a domestic violence class for 16 weeks.
