MALIBU—Caitlyn Jenner will face no manslaughter charges for the collision that involved her black Cadillac Escalade and a white Lexus on February 7 near Corral Canyon Road.

Driving along the Pacific Coast Highway, Kim Howe, 69 was struck and killed when her vehicle was hit from behind by the SUV that was carrying an additional vehicle and forced into oncoming traffic, striking a Hummer. Prosecutors have chosen not to charge Jenner as a result of a lack of evidence which indicates that Jenner was at fault.

According to reports, Jenner applied the car’s breaks less than 2 seconds before the the crash and indicated that the vehicle was below the speed limit, but going too fast for the road conditions on that day, Detective Richard Curry of the Los Angeles County Sheriff’s Department indicated to the Los Angeles Times.

The Los Angeles County Sheriff’s Department previously wished to cite Caitlyn Jenner for manslaughter, but further evidence presented, indicates that Jenner was driving cautiously.

Footage of the incident, interviews, driving and cellphone records were all taken into account during the 6-month long investigation.

Jessica Steindorff, another victim in the accident, behind the wheels of a 2010 Toyota Prius, was charged with a misdemeanor of driving with a suspended license. Investigators originally alleged that Steindorff’s car was struck by Howe’s Lexus, which was hit by Jenner’s vehicle. Further investigation revealed Jenner’s SUV hit the Lexus then proceeded to keep going, striking Steindorff’s car.

Although no criminal charges are being filed against Jenner, Steindorff’s and Howe’s family plan to seek a civil case the reality television star and former athlete.

Jeffrey D. Wolf, defense attorney for the Howe family, claims that Jenner is to blame for the crash.

“Now, ultimately a jury trial in this civil case is the only way to hold Ms. Jenner accountable for causing Kim Howe’s death. We are going to continue our efforts to ensure that justice is served,” said Wolf.

As an advocate for transgender equality, Jenner has won an Arthur Ashe Courage Award at the 2015 ESPYs. She was formerly known as Bruce who won a gold medal at an Olympic Triathalon in 1976 and has two children from a former 20-year marriage to Kris Jenner, with whom he has appeared on reality television show, “Keeping Up With the Kardashians.”
